Unauthorised encampments in the borough

Chertsey Recreation Ground

The Council is aware that a group of travellers are on Chertsey Recreation Ground, Guildford Road.

Five caravans and other associated vehicles arrived last night. The Police and Council officers have attended the site to complete the required welfare checks to start the eviction process.

Update: 12/08/19

The Council has authorised a Direction under the Criminal Justice and Public Order 1994 requiring the occupants of the encampment to vacate the site.  

Officers served the Direction earlier this afternoon which will give the travellers until 9am tomorrow (13th August) to leave the site and remove their vehicles and other property. 

If they fail to comply the Council can then apply to the Magistrates' Court for a Court Order authorising it to remove the people and vehicles there.    

Update: 13/08/19

The unauthorised encampment made up of five caravans is still present at Chertsey Recreation Ground.

The Direction served under the Criminal Justice and Public Order 1994 directing the occupants to vacate the site on 12/08/19 has been breached.

The Council has therefore applied to the court for a hearing, and the complaint will be heard on the morning of Thursday 15 August. A summons to appear at court has been served on the group.

If a Court Order is granted, the Council is authorised to remove persons and vehicles present if the group fail to move within 24 hours of the service of the Order.

Update: 15/08/19

Four caravans are still present on Chertsey Recreation Ground.

This morning, the court have granted the Council an Order which requires the encampment to leave the site by 11.30am on Friday 16 August.

Should the Order not be followed, the Council is authorised to take such steps as are reasonably necessary to ensure that it is complied with.

 

Update: 16/08/19

The encampment left Chertsey Recreation Ground on 15/08/19 at approximately 20:10 in accordance with the Order that was issued. 

However, the same group have set up another unauthorised encampment on Englefield Green near the children's play area.

Council officers have attended the site and completed welfare checks required to start the eviction process. 

The Council has now authorised a Direction under the Criminal Justice and Public Order 1994 requiring the occupants of the encampment to vacate the site.  

Officers served the Direction earlier this afternoon which will give the travellers until 5pm tomorrow (17th August) to leave the site and remove their vehicles and other property. 

If they fail to comply the Council can then apply to the Magistrates' Court for a Court Order authorising it to remove the people and vehicles there.    

The Council has also served a copy of its Open Spaces Injunction at a prominent position on the green, compliance of which will be monitored by both officers and the Police.
